Hogarth Timber Ltd
- Introduction
These Terms and Conditions apply to all products supplied by Hogarth Timber Ltd (“we”, “us”, “our”) to customers in England and Wales. By placing an order, you agree to be legally bound by these Terms.
Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or other applicable consumer protection laws.
- Our Products
We manufacture and supply made-to-order timber buildings including garden rooms, shepherd huts, camping pods, sheds, kennels, and summerhouses.
All products are constructed using natural timber. Timber is a living material and natural variations in colour, grain, knots, movement, warping, splitting, resin bleed, and shrinkage may occur. These characteristics are normal and do not constitute defects.
Product images, descriptions, and dimensions on our website or in brochures are illustrative. Minor variations may occur as part of the manufacturing process.
- Quotations and Orders
All quotations are valid for 30 days unless stated otherwise.
An order is only confirmed when:
- The required deposit has been received, and
- We have issued written confirmation of acceptance.
We reserve the right to decline any order before confirmation.
- Deposits
Deposits are required to secure a production slot and begin manufacture.
- Sheds, kennels, and summerhouses — £200 deposit
- Garden rooms, camping pods, and shepherd huts — £1,000 deposit
Deposits become non-refundable once production has commenced, as materials and labour will have been allocated. Prior to production, we may retain an amount to cover costs already incurred.
- Pricing and Payment
All prices are in GBP and include VAT unless stated otherwise.
The remaining balance is due on or before delivery unless otherwise agreed in writing. We reserve the right to delay delivery or installation until full payment has cleared.
We may charge reasonable storage fees if delivery is delayed at the customer’s request.
- Cancellation Rights
6.1 Made-to-Order Goods
Our buildings are made to the customer’s specifications. Under the Consumer Contracts Regulations 2013, the 14-day cooling-off period does not apply once production has begun.
6.2 Cancellation Before Production
If you cancel before production starts, we may deduct costs already incurred (such as design work or materials ordered).
6.3 Cancellation After Production Starts
Once manufacture has commenced, payments made are non-refundable.
- Lead Times
Any lead times provided are estimates only. We are not liable for delays caused by circumstances beyond our reasonable control, including severe weather, supplier shortages, transport disruption, illness, or other force majeure events.
- Delivery and Installation
8.1 Customer Responsibilities
The customer must ensure:
- Safe and adequate access for vehicles and personnel
- A suitable, level, and properly constructed base
- Clear working space around the installation area
- No hidden underground services, pipes, cables, or obstructions
- Compliance with planning permission or building regulations where required
We are not liable for delays, damage, or additional costs arising from unsuitable access, inadequate bases, or hidden site conditions.
8.2 Risk
Risk in the goods passes to the customer upon delivery to the agreed site.
8.3 Ownership
Ownership of the goods remains with Hogarth Timber Ltd until full payment has been received.
- Planning Permission and Regulations
It is the customer’s responsibility to determine whether planning permission, building regulations approval, or other consents are required. We accept no liability for buildings installed without necessary permissions.
- Warranty
We provide a 12-month manufacturer’s warranty from the date of delivery covering defects in workmanship.
This warranty does not cover:
- Natural timber movement, splitting, or warping
- Weathering or colour changes
- Lack of maintenance or protective treatment
- Damp caused by poor ventilation or unsuitable bases
- Ground movement or subsidence
- Alterations or modifications made by the customer
- Damage caused by extreme weather, misuse, or accidental damage
Our obligation under this warranty is limited to repair or replacement of the affected part at our discretion.
This warranty is in addition to your legal rights.
- Maintenance
Timber buildings require regular maintenance, including treatment with suitable wood preservative and weatherproof coatings in accordance with manufacturer guidelines. Failure to maintain the building may invalidate the warranty.
- Defects and Damage
Any visible damage or shortages must be reported within 7 days of delivery. We ask that customers provide photographs where possible.
This does not affect your statutory rights regarding goods that are faulty or not as described.
- Limitation of Liability
We are responsible for losses you suffer as a result of our breach of these Terms that are a foreseeable consequence of that breach.
We do not accept liability for:
- Loss of profit, income, or business
- Indirect or consequential losses
Our total liability shall not exceed the total price paid for the goods.
Nothing in these Terms limits or excludes liability for:
- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Any matter that cannot legally be limited or excluded
- Force Majeure
We are not liable for any delay or failure to perform our obligations due to events beyond our reasonable control, including but not limited to severe weather, fire, flood, supplier failure, transport issues, labour shortages, or acts of God.
- Variations
We may make minor changes to design, materials, or specifications where necessary due to availability, safety, or manufacturing improvements, provided the overall quality and function are not affected.
- Photographs
We may take photographs of completed installations for marketing purposes. Please inform us in writing before installation if you do not consent.
- Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the jurisdiction of the courts of England and Wales.
